Will of William Rice, Gentleman of Alphington

This is the last Will and Testament of me William Rice of Alphington in the County of Devon Gentleman formerly residing in the Parish of Saint Mary Aldermanbury London I give all my own clothes and wearing apparel to certain ffriends of mine to be named by me to Mrs ffisher the same to be distributed as she may direct I give the watch I now wear which I purchased of the late Mr William Benison together with the Gold Chain and seals attched to it unto my friend Mr George Benison of Exeter Gentleman to and for his own use and benefit And I give devise and bequeath unto the said George Benison and Samuel Lillycrop of Exeter aforesaid Professor of Music all my Household Goods and ffurniture moneys in my possession And owing to me from Any Person or Persons And securities for money Books Plate Linen and China And all other my Personal and Testamentary Estate and Effects whatsoever and wheresoever not hereinafter specifically bequeathed To hold the same respectively unto the said George Benison and Samuel Lillycrop their Executors and Administrators upon Trust nevertheless that they the said George Benison and Samuel Lillycrop or the Survivor of them his Executors and Administrators do and shall as soon as conveniently may be after my decease in such manner as they or he may think proper convert the same not money into money and collect sue for and get in all debts and moneys due to me And shall out of the proceeds arising from my Personal and Testamentary Estate and Effects so as aforesaid bequeathed to them in the first place pay and discharge my just debts and ffuneral and Testamentary expences And then do and shall invest the clear residue thereof on good real and Government Security or Securities at their or his discretion And do and shall pay the dividends and interest thereof or apply the same dividends and interest as the same shall from time to time become payable and be received unto and for the benefit of my late Wife's Grand Niece Ann Tootell who is now living with me during her minority and on her attaining the age of Twenty one years Then I direct that the whole of the said principal moneys Estate & Effects and the securities for the same shall be paid and transferred unto the said Ann Tootell her Executors Administrators and Assigns to and for her and their own use and benefit absolutely But in case the said Ann Tootell should die under the said age of Twenty one years The immediately upon her so dying under that Age to pay and transfer of the said trust monies Estate and Effects and securities unto Elizabeth Back the eldest daughter of John Back of Saint Thomas the Apostle Devon Builder and ..... and her Executors Administrators and Assigns And I hereby constitute and appoint the said George Benison and Samuel Lillycrop Executors in Trust of this my last Will and Testament hereby revoking all former Wills by me at any time heretofore made And I hereby declare that the receipts of my said Trustees and Executors shall be good and sufficient discharges to all persons paying them money that one of them shall not be answerable for the other of them but each for his own acts only and neither for any involuntary loss unless from wilful neglect or default and that they shall respectively deduct and reimburse themselves all Cost and expences which they shall incur or sustain in or about the execution of the Trusts of this my Will In Witness whereof I have hereunto set my hand and seal the Eleventh day of June in the Year of our Lord One thousandeight hundred and thirty four William Rice
